Judgement on hunting during the pilgrimage

First of all, the pilgrimage is the 5th pillar of Islam. It is compulsory for all Muslims who can afford it to make it at least once in their lives. It should be emphasised that pilgrims are subject to certain rules during the pilgrimage. Here we look at judging hunting during the pilgrimage.

Judgement on hunting during the pilgrimage: what does the Koran say?

To begin with, several verses in the Koran shed light on the following points the hunting position for the pilgrim. 

Thus, Allah says: "Do not allow yourselves to hunt while you are in a state ofihram". (Sura Al Maidah verse 1)

We can also quote verse 96 of the same sura in a close translation of the meaning of the verse. That is to say: "You are permitted to hunt at sea, and also to eat of it, for your enjoyment and that of the travellers. And hunting on land is forbidden to you as long as you are in a state of ihram. And fear Allah to whom you will be gathered".

Moreover, again in Al Maidah, verse 2, He says: "Once you have been desecrated, you are free to hunt".

Finally, from all these ayats, we are able to judge the fact of hunting during the pilgrimage. In other words, they're proving to us that it's clearly banned.

However, we learn from the sunnah of the Messenger of Allah ﷺ that it is permissible for the pilgrim to kill certain vermin.

More specifically, these are the kite, the scorpion, the mouse, the crow and the aggressive dog (according to Ibn Umar reported by Mouslim).

Other bans

You should also know that the Fouqaha (scholars of jurisprudence) have deduced from the hadiths of the prophet various things that are also forbidden for the person who is in a state of ihram.

Like wearing sewn clothes or perfume, for example. There is also a ban on picking plants or uprooting trees (Al Boukhari and Mouslim).

The person who transgresses this rule must make an atonement. This means either sacrificing an animal or feeding the poor. Or fast.

The proof of this can be found in the words of Allah in verse 95 of Sura al Maidah.

"O believers! Do not kill game while you are in a state of ihrâm. Whoever of you deliberately kills any, let him then compensate either with some herd animal similar to what he has killed. According to the judgement of two upright persons among you, and that as an offering which he will send to (the destination of the poor of) the Ka`bah. Or by atonement, by feeding the poor, or by the equivalent in fasting. This is so that he may taste the evil consequence of his deed. Allâh has forgiven what is past; but whoever re-offends, Allâh will punish him. Allâh is Mighty and has the power to punish.
